On Thursday, a federal judge rejected former President Donald Trump’s request for special prosecutor Jack Smith to defy the court’s efforts, as he submitted documents to the court during the suspension of Trump’s criminal election contingency plan.
Judge Tania Chatkane wrote in an order from the Federal Court in Washington, D.C. that the order to suspend the trial of the case until Trump appealed against the unfavorable ruling “did not explicitly prohibit” Smith’s actions.
“Adhering to submission deadlines and explicitly prohibiting submissions are not the same thing,” she wrote.
But Chatham agreed to Trump’s request that Smith and other parties must obtain her permission before proposing further pre-trial motions.
Trump spokesperson Steven Zhang described this decision as a “strong condemnation” of Smith in a statement. But Chatcan’s order states that this measure “does not indicate that the government has violated any of its clear and explicit terms or acted maliciously.”.
Trump’s lawyer accused Smith of violating court orders by providing evidence and filing a motion after the federal election case deadline was postponed.
Smith is attempting to expedite the trial of Trump’s alleged illegal conspiracy to overthrow his defeat to President Joe Biden in the 2020 election. The case is currently scheduled to start trial in early March.
Last month, the federal district court automatically shelved the case, and Trump appealed against Chatham’s refusal to dismiss criminal charges on the grounds of presidential immunity.
The panel of judges from the Federal Court of Appeals heard an oral debate last week regarding Trump’s claim of “absolute immunity” from formal presidential action.
